Unfortunately, Council do not have a date when Interim Planning Controls will be approved. Here's the latest from Banyule Council regarding the update on the Ivanhoe Structure Plan.

Update from Banyule Council:

On the 3 June 2013 Council decided to ask the Minister for planning for interim planning controls for the Ivanhoe Structure Plan Area. Council also resolved to seek Authorisation from the Minister to exhibit planning scheme amendments for permanent planning controls for the Ivanhoe Structure Plan Area.

The planning scheme amendment documents that have been submitted to the Department of Transport, Planning and Local Infrastructure (DTPLI) are as follows:

PROPOSED PLANNING SCHEME AMENDMENT C91 & C93

Planning Scheme Amendment C91 is for interim planning controls. Planning scheme amendment C93 is for permanent controls.

These amendments embody the Ivanhoe Structure Plan by changing parts of the Banyule Municipal Strategic Statement (MSS). The amendments also introduce Design and Development Overlays (on heights and setbacks) and change the zoning of some properties in the activity area.

PROPOSED PLANNING SCHEME AMENDMENTS C92 & C94

C92 is for interim heritage controls. C94 is for permanent heritage controls.

The Ivanhoe structure planning included heritage studies of key residential areas and individual places. The studies found that one place and two precincts were worthy of inclusion in a Heritage Overlay:

  • Interwar shop, former post office, at 1041-1041a Heidelberg Road
  • Kenilworth Parade Precinct
  • Toora Street Precinct

The amendments will ensure that the heritage places are protected from inappropriate demolition, alterations or additions that may threaten the significance of the precincts or buildings.

The Minister is expected to make a decision on Council’s request for the interim planning controls once he has received departmental advice on the amendment. 

Council is continuing discussions with the Department of Transport, Planning and Local Infrastructure to confirm the final amendments. Council is committed to ensuring that the amendment documents reflect the directions outlined in the Structure Plan.


A further update on the progress of the planning scheme amendments will be provided as soon as it is available.
